The notion of "Joint criminal enterprise", the prosecution's use of historians to paint a context going back hundreds of years, most definitely suggests that they want the judgments not to be mere punishments for war crimes and contraventions of the Geneva convention.

Also at issue is the matter of prosecution and indictments themselves, especially concerning Bosnian Croats where the crimes that most were convicted for should have been handled by the domestic courts. Much more severe war crimes are being handled by the domestic judiciary, but the damage has been done already, as the numbers at the ICTY have been skewed.

They went particularly hard against the Bosnian Croats (as Croats proper were judged by Tudjman to be off limits) in the late 1990's, in order to soften Serbia's opposition and the view that the ICTY was exclusively an anti-Serb institution and to get Milosevic to cooperate.
